BOC-3

BOC-3 is the FMCSA filing that designates a "process agent" in every state you operate in — someone who can legally receive court papers on behalf of your trucking business.

What you actually need to know

Every for-hire motor carrier with active MC authority must have a BOC-3 on file with the FMCSA. The BOC-3 names a process agent (essentially a registered address) in every state where you operate, so if you get sued, court papers can be served somewhere reachable.

You don't file BOC-3 directly. You hire a "blanket" process agent service to file it for you. A blanket agent covers all 50 states in one filing, which is what almost every carrier uses. Cost: $20–$50 one-time, sometimes with a small annual renewal.

BOC-3 is required before your MC authority goes from "pending" to "active." If you file MC authority but skip BOC-3, your authority sits in pending status indefinitely and you can't legally haul freight.

Common mistakes / confusions

  • You can't designate yourself as your own BOC-3 agent. You need a third-party service.
  • Filing services bundle BOC-3 into their $1,500–$2,500 package, but you can buy it directly from a blanket agent for $20–$50.
  • BOC-3 is a one-time filing for most carriers. Some agents charge annual renewal; many don't.
